I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.

Online status says my applications were recd on Oct 2/ 2007.
My reciept notices show the right date in August.
Is there any need to worry or notify any one about this?

Don't worry about the online status. Many people are receiving mismatched time between the receipt and online...

Hi All,
I am sure this has been discussed in detail before but I couldn't find the related threads..So i am posting it again..Sorry for the spam..
My wife converted from H4 to H1 last year (H1 started Oct 2007). She has been working for the H1 sponsoring employer since 10/1/2007...She plans to take a break now and relax for a few months for personal reasons...Can we update the I-9 form with her EAD info and work for a few days and then take a break...I know by doing this she will lose her H1 status but we are fine with that as she will be using her EAD moving forward...I am a July 2nd filer with 140 approved, so I dont see any risk in my I-485 as it is a pretty straightforward case...Have been with only 1 employer since Jan 2001 with PD: Nov, 2003 EB-3 India.
I just wanted to check if this is ok...Any thing that we need to look into before changing the I-9 to EAD....

On March 12 2009 I got an query on my I-485.
Requesting discrepancy in the labor applied on Nov'7 2002 and present working place.
My company(abc ltd) applied labor on Nov'07 2002 while I was working at the clients(xyz) place in Los Angeles.
I got my I-140 approved on Feb'15 2006, while I was with the same client(xyz) at that time.
On Dec'04 2006 I moved to Detroit, started working with different client.
RFE goes like this.
The Documentation submitted with your application and/or a review of service records indicate that you no longer reside in the same state or geographical location as the underlying form i-140 immigration petitioner and /or job location specified by your intended permanent employer.
There fore submit a currently dated letter from your original form I-140 employer which which address this discrepancy.
I am still working with the same employer who filed my labor certification.

USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. I fall in Schedule A which is going to retrogression begining Nov, 06.
I am on H4, meanwhile i just made it to file my I140, 485, 765 and AP concurenntly, hence will get my EAD, but no approved 485. My situation is I dont want to be with this employer for long for this is in upstate MI, where my spouse wont be able to continue the H1, hence we will be living seperate for sometime.
Now after my 140 approval and 485 pending for 6 months can i change the employer, I heard something with AC 21 you can. But what are the pros and cons with it.
Can my employer revoke the approved 140 after 6 months too.

My employer mentioned that my job description is Senior Analyst in the application. Does that mean I have to be a Senior Analyst till the time I get GC ? Cant I take up another job like Architect ?
Also, for 140 application do I have to sign on any PERM labor related document ?

I have been working in DFT/Test field for few years now and it appears that my current group is leaning more and more towards Test Development for SOCs and less in DFT work. I really would like to pursue DFT as a career and have been looking for a job in DFT field. Not only that, moving to a newer company might help me in getting the green card faster; possibly.
Is anyone here working in the DFT field? If so, do you know of any job openings in your group or anywhere else for that matter?

The early retirement of US Senator Mel Martinez (R-FL) has opened up an appointment opportunity for Governor Charlie Crist, himself a candidate for Martinez's seat. For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. We (I and my wife) filed for 485/EAD/AP on July 27 2007. We received all documents (receipt#, AP, FP etc) except EAD for my wife. The case status online shows her EAD application was received and pending. So on Jan 24th we put a Service Request for her EAD application. Yesterday we received a letter from USCIS with the following information --
The status ofthis service request is:
WAC-XX-XXX-XXXXX
Your 1-765 application was administratively closed on 0112912008.
If you have any further questions, please call the National Customer Service Center at 1-800-375-5283.
If anyone has similar experience or know why they would close a case without giving any information or RFE/NOID etc? I tried calling them but the IO couldn't provide any further info.
