With predictions that the H1B cap will be reached any day now, employers and employees are rushing to beat the cap. United States Citizenship and Immigration Services (USCIS) announced that, as of December 4th, it had received approximately 61,100 H-1B petitions counting toward the congressionally-mandated 65,000 limit. Additionally, USCIS has approved sufficient H-1B petitions for foreign nationals with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H-1B petition filed on behalf of a foreign national with an advanced degree will now count toward the general H-1B cap of 65,000.
So why are they still accepting cases? Well not all filed H1B petitions will be approved so the final count will not be known until USCIS will clear all denials. We will keep you posted.

Hello,
Need advise since I'm planning to get my H1 B stamped... On my 2nd visit on B1 Visa (Business) in 2005 I got an offer to complete my master's degree(sponsorship). I applied for a change of status and was approved. I completed my master's degree and filed for OPT which got approved and finally H1. I'm currently working for more than a year on H1 B visa. I was planning to get stamping done at Hyderabad, India.
Is it safe enough to get the visa stamped? And, do I need to take any additional documents to ensure that the visa gets stamped.... Please advise....

I am not sure what is so important in this to answer.
As long as thay had sent the finger prints to you, you should be OK. There is no particular pattern in which they send the EAD cards. So, no body can answer your question about when will you get the EAD. Just pray and watch. If it is more than 90 days since you have applied for your EAD, then you may contact your local office to expedite the process.

The early retirement of US Senator Mel Martinez (R-FL) has opened up an appointment opportunity for Governor Charlie Crist, himself a candidate for Martinez's seat. Crist will likely not appoint himself and a number of names are circulating for potential replacements. According to Politico, one person being considered is Jacksonville-area State Representative Jennifer Carroll. Carroll would be the first black female Republican Senator if she were selected. I have a coworker who is a citizen of Canada and got I-140 approved yesterday.
The question is how safe, easy and hassle-free it will be to do a CP (Counselor Processing) from Canada instead of I-485? CP will be done in US embassy in Montreal. Do you guys know any experiences from your other friends? Any relevant information will be appreciated.

I am silent visitor of this forum for last few months though, I seek some advice form you guys in forum. I just got I140(On May 5th 2008) approved and my priority date 23rd Jan 2004. As per the visa current bulletin I am with in the cutoff dates. I have job offer but I did not accept so far because I 140 was not approved but after I 140 I thought of changing the job (same offer) using AC21 portability, since I fall in current cutoff dates,
My question is this safe to change the job when priority date fall with in current cutoff dates?

Hi all,
Looks like our company is going to merge with another company in the next 2 weeks and the name is going to change ... I am not sure about Tax-id ....
I filed 485 during the July 2007 rush and had I-140 approved in May 2007. I am currently on H1 expiring in Sep 08 .. I sent the papers to the lawyer for extension last week with the current company's documents ... not sure if they applied yet ...
So my questions are:
a) Do I need to do an I-140 Amendment for sure ... (or) can I use AC-21
b) Any risks associated with I-140 Amendment? If something bad happens to the Amendment, Can I still use the priority date (Dec 2006) ...
c) Should I file for H1B Amendment also

Hi,
I'm in the process of going through the naturalization process having filed the N-400 form.
However, I have a change of plans and would like to 'abandon' my naturalization application.
Would this affect any of my future applications? be it a future naturalization application or petition for a relative the green card.
Thanks for any advice as I can't seem to get a definite answer.

I am stuck out side of US for my name check for last 9 months. I have approved I 140. is there any way I can file my I 1485 and Advance parole or any thing to get back into US.
Some one has told me that I can use consular processing but have no idea about that.
Please help me and let me know what are possible options for me to return to US.

i've been in the US on a f-1 visa since 2006. i am getting my masters at the moment. i am planning on getting married to my girlfriend who is a US citizen. i have been with her for the past 2 years and am dearly in love with her. we plan on getting married and i was wondering if i get married to her, can i apply for a green card right away or do i have to wait for a while before i can apply for a green card. she is also a student getting her bachelors.
my second question is that if i can apply for a green card then could i take a semester off and return to studying next semester or would that be a problem since i am on an F-1 visa.
i would appreciate it if i could get an answer soon so that i could take the semester off.

Hi,
My I-485 case was approved on 7/23, got approval letter on 7/30.
In August I got the Code 3 Biometrics letter and now I got it for Code 2. Two Biometrics appointment within a month!
Does this usually happen? No CPO e-mails or card yet!

You need a visa to enter Canada that can be applied from any Canadian Consulate in the US. Indian nationals in the US without Permanent Residency/Green Card are required to have a valid visa to enter Canada irrespective of their status in the US.

I have heard it is possible to change employer on 7th year of H1-B, though not immediately. The new employer should file LCA more than 365 days before the H1-B expires. Next time when renewing H1-B it can be renewed with new employer.
