Hi All,

I have got an RFE for my I-485 application. . I missed to complete a question (part3 and question #10) in I-485 form for which I got a request for evidence letter from USCIS. Can anyone has any template on how i should reply. Your help is much appreciated . Thanks in advance

fraudulent documents or by fraud or willful misrepresentation of a material fact, ever sought to procure, or procured, a visa, other documentation, entry into the United States or any immigration benefit.

Therefor submit an affidavit with your answer to this question a 'Yes' or 'No' response.

Hi I received receipt for I-485. Can you please help me with the EAD application? I have the questions

1) Can I do this electronically?
2) which service center should I send EAD application to? 485 sent to Texas
3) DO I need copy of original receipt or printout from the website is fine
4) Can I file for only 485 and file the AP later.
5) What documents DO I need
6) Do I need to pay filing fee?

Help will be highly appreciated

I can tell you from my past dot com bust experience, getting companies to file for GC had become very tough. Getting labor certification cleared was even a bigger challenge. I can say, when economy goes south, immigrant's life gets tougher. Hope for the best, prepare for the worst.

No. Wife's status change is independent of husband. H1 status of husband is not invalidated by wife's use of EAD.

Hi there!
I was reading some info abt EAD on this site and have come to know that Once H4 visa holders get their EAD's can work after getting SSN.But I read that If H4 visa holders start working as soon as they got EAD's.Does this invalidate H1 visa status if wife starts working on EAD.Please clarify my doubt.

Hi

I am masters student graduating in June 2011. I got an offer from a big company and it already started h1b premium processing(applied on Mar 31). Now, I received an offer from my dream company and I didn't mention about h1-b processing and want to work for this company. I have few questions and need your suggestions.

1. Reject the first company offer. Not sure if I have to pay, because they applied for H1-B premium processing. How much I have to pay in this case? Can I continue working on OPT in this case?
2. Inform the second company about the first company h1-b processing. What can second company do, if H1-B is already processed? What can second company do, if H1-B is not processed?

Please suggest if there are better ways to handle the situation.

-- How long does it take to get H1-B visa under premium processing, if applied in 65000 pool?

Hi - I am currently on H1B visa with 3 more years to go and visa stamped for next 3 years. I've got offer for Medical residency and they offer J1 only.

I am planning to change my status to J1 effective July 01 2009. Do I need to go India for visa stamping or any other procedure? Is just change of status okay?

Please help if you know anything related to this procedure.

Hello Everyone,


My wife is trying to process visitor Visa for her parents and she has a problem with her mothers name in the Passport as it reads just the short name instead of her Full name.


I'm wondering if the Affidavit would be sufficient while going for Visa or would this still be a problem?

If affidavit is sufficient, can someone please kindly share the sample affidavit if you have one?

Hi

My wife H1B was approved under Consular Processing. She got job offer now and it is a Consulting job to Hire. We applied COS at CSC by Premium processing. Reached application on Sep 28 and Status is Acceptance by then.

1 ) Everything is genuine and in the client letter it is mentioned as 6 Months contract to hire. Are there any posibbilities of getting H1B approved for only 6 months from now.

2 ) Are there any chances of rejection

3) Sincle past week it is under "Acceptance" stage. I know i have to be patient.

4) Can we expect some decision from them this week as client is waiting.

5) At what time CSC updates the case. Is there any particular time they update the case online.

My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.

I am planning to go to Ottawa now for a stamp that expires in Sept 08.

Thanks for your help.

Visa stamp doesnt define your legal status or your stay period ,it is the latest I 94 . Visa stamp is only required when u travel outside the country.
