One of my friend's I-485 with priority date of Jan 2006 got approved yesterday. They have posted the documents to USCIS for his wife early this month(as per his attorney) to link to his I-485, but the check was not cashed yet and receipt notice was not issued for his wife.
Will there be any issue in this regard? What will be the options for him just in case if the attorney has not sent the documents to USCIS for his wife or the documents get rejected for some reason? Any help/advice in this regard is really appreciated. Thanks.

I guess this has become typical of every lawmaker to say 'We need to reform ______', without initiating any action. So far health care, immigration, financial industry have gone in that blank, more to come..

I was reading some info abt EAD on this site and have come to know that Once H4 visa holders get their EAD's can work after getting SSN.But I read that If H4 visa holders start working as soon as they got EAD's.Does this invalidate H1 visa status if wife starts working on EAD.Please clarify my doubt.

Can someone tell me a little bit about visitor visa validity dates. For eg: if my parents got a 3 month visa, is it valid from the date it is issued or from the date of entry into the US?

I got my first H1B transfer through a lawyer. The lawyer charged $3500/- out of which approx $2500 has to be paid by the employer as per law the lawyers charges would be around 1000 dollars for some paper work.
My second H1B transfer costed be 1200 dollars as lawyers fee and all other charges has to be paid by the employer as per law.
Its best to get an immigration lawyer involved since you can have a peace of mind. There is no need of premium processing. Once you get the receipt you can join the other firm. You don't have to wait till the process gets completed.

I have a question regarding the H1 / H4 status of my spouse.
My spouse entered US in 2006 on H4 visa (valid till 2008 ). In 2007 she applied for H1B and the I 797 start date is October 2007. She did not apply for any status adjustment (from H4 to H1). She did apply for SSN using the EAD and presently not working.
I just wanted to know, what is her visa status now. Is it H4 or H1?

I am an EB3 INDIA PD:August 2001 expecting long wait for greencard.
I am Canadian PR and have been offered job by my current company's Toronto office. Company will continue US GC process but till I get GC I will be in Canada on Canadian payroll so legally cant visit US on H1B visa.
My spouse is doing a professional degree in US which will last another 2 ys. She has expired H4 visa stamp on passport. She will be applying for H4 --->F1 conversion.
My question is can she return back to USA after visiting me in Canada using AVR ? She would be on F1 but with expired H1 on passport ? She will not apply for new visa in Canada and leave within 30 days.

One of the docs folks usually send is an employment letter from your new employer detailing the job duties, etc.
Most would give you this only after you join the new employer.
I don't think an offer letter with job duties would suffice.

I have the a situation where I need some advice:
I got my first job in june 2005 and was on my OPT until dec 2005. My H1-B was filed by this company and it started from Jan 1, 2006. Now I left the company in Sept 8 2006 and joined a consulting (vendor) firm. I am a contractor at Microsoft through this firm. This firm filed my H1-B on Sept 9, 2006. Now, 2 weeks back, when I checked the status of my case, I saw USCIS sent an RFE requesting more documents from my firm regarding the contract and type of job description. They gave a deadline until feb 2007 to submit docs.
My first initial contract length at Microsoft through this firm is until April 2007, but is more likely to extend for another 6 months.
Now my question is, since I cannot be sure if the contract will extend, I am starting to look for jobs...If I get a job, will it be alright to accept it and have that new company file my H1-B even though my current H1-B from my current firm is still in process and not approved yet?

Hello folks. I hope someone can help me out on this issue. I applied for my wife's EAD back in July 2007. The EAD was processed in two weeks and we received the card. However, my wife's middle initial was incorrect and we sent it back to USCIS with an explaination concerning the mistake. USCIS stated that it would take anywhere from 2 months to 6 months to process the correction. Last week I received a letter from USICS stating that I need to submit a completed I-90 form. A I-90 form is used to replace a green card. We just applied for our adjustment of status in 6/2007 and are not permanent residents at this point. Getting the EAD has become a nightmare for us. Do I try and write a letter back to USCIS stating that they are asking for the wrong form. I tried to call them but they said to respond to the letter sent. I'm stuck between a rock and a hard place. Any help/advice would be appreciated.

I think you can employ any one on 1090 on temporary basis(nanny or home improvement, reapir etc) , not employ by start a company. Ask a lawyer.
