    What does it take to port from EB3 to EB2 (aside from job requirements, duties and all that), specifically:

    . Do I have to file labor/I-140 all over again ?

    I just received my initial EAD and it is only valid for 1 year. My priority date is October 2006. Shouldn�t I have received an EAD valid for 2 years?

    Hi friends,

    Today I had a LUD on my old I-129 (approved in Aug 2005). The online status say: �On August 29, 2007, the post office returned our last written notice on this case as undeliverable. This can have serious effects on the processing of this case. Please call 1-800-375-5283 to update the mailing address so this notice can be re-sent.�

    I'm no more working for this employer and I�ve changed to a new employer a year ago. What does this status mean?Any ideas?

    Does this cause any problem to my current GC process which was sponsored by current employer?

    If there is a anti immigration material in any website, instead of pointing a link to it, it is better to copy paste the content here. This way we can avoid HITs to the website. The reverse could be done for pro-immigrant news/articles etc where the link will help us to post comments on the news website directly.
    Of course there are some sites where registration is required and you can copy the content in that case for the benefit of others.

    Hi: Need some inputs from the excperts in this group on using the priority dates from a different I140 filing.

    Have the following 2 cases filed for the same person.
    PD - Nov 2004 - EB3 - Labor Approved - I140 Filed
    PD - Oct/Nov 2005 - EB2 - Labor Approved - I140 Approved

    If we file I485 based on the I140 approved for EB2 case [which has a later PD], can we still send an update to USCIS later regarding Nov 2005 PD and use that PD once the I140 from the EB3 filing is approved? What's the best way to use the highest EB category and oldest PD in this case?

    My 140 was filed for a future Team lead position. I am currently a Sr Sw Engg with the same employer. The job description is nearly the same. But I am not sure how this little quirk effects my AC21 eligibility. When does my 180 day start counting ? From filing date or from the date I get the Team lead title ?

    Gurus,

    First of all apologies if this has been asked before (in that case will appreciate if someone can post the link or keywords to search for).

    Looks like it will be a long wait for many of us to get green card. Was wondering if there are any state/federal college plans or something similar which allows non-immigrants to participate. If not, are there any equivalent private plans available. I'm sure any inputs will help.

    Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.

    I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

    Hi,
    What is the difference between "reject" and "deny" in USCIS terms? Is it that reject is even before the case is processed and when application is returned back immediately and "deny" is later when the case is looked into and then the aplicant is found ineligible for whatever reasons?

    If this is indeed the case how much time does one have after getting an RN to submit additional evidence he/she may have missed initially but before the case is processed?

    any ideas from the adjucators manual?

    Does any one knows why EB2 India is not approving in comparison to 2006.

    As my understanding that USCIS should process application in FIFO and PD.

    My PD is Feb 2005 and when I talked to CS he told me that everything is cleared and my case should be approved .

    He told me to call after 68 days ( don't know why) if my case is not approved till then.I am seeing peoples with 2006 PD are getting there GC .

    My company got one previous LC approved whose requirements are BS in CS or Engg related. I have a civil engg degree, I would like to file I140 and get old PD. Will this substitution work? If anyone with "non CS" engg degree used a labor that asked degree in "CS or Engg rel" in item 14 on 750A please share your response.

    you can claim him if:
    1) He didn't earn more than $3500 in 2010
    2) You have proof of providing more than 50% of his expenses (ie. paid his tuition etc.)
    3) He was in the US for more than 180 days in 2010 (ie. US resident for tax purposes)

    If you paid for his tuition, you may be able to claim tuition credits for him too.

    Hi All

    I am here on L2 and then Joined a Company in 2006. When I joined, that time the H1 Cap 2007 was already over so my company said that they will do my H1 this year. Unfortunatly I got the H1 Rejected as my case couldnt get in the lottery.

    In the Mean time my company have filed my Green card under EB3 and we have I-140 Approved (1 st stage) in August 07.

    Now, is there any way that anyone can Help me?
