Did you ever hear the proverb "quitters never win" and winners never quit.

Quit here go to Canada and then face some problems there and then quit canada. And then you will become the rolling stone which gathers no mass. Your family will be sick of your shifting then and no stabilization will cause more issues.

A friend of mine told me this one evening when I was really frustrated and was planning to quit my dream on being an entrepreneur and here I am now, and I think where I am right now is for the reason that I didn't quit that day and finally my product was liked by a company and they bought the product and offered me a job as well and then one thing lead to another and now I am settled with what I always wanted to do ( kinda not 100%) but its ok.

Instead of ruining our life running after GC, here are few options

    1) if you really want to live in a developed country, move to Canada or Australia. their process is much simpler and faster
    2) cash out your investments and move to India. you might end up back in US on L1 :)
    3) since some of us have had babies here, wait till they can sponsor you.

i have personally done 2 of the above. I have a Canadian PR and i have established contacts in India in case i need a job there. What am i doing here? saving as much money as i can, and waiting for the right opportunity in Canada or India. GC can kiss my ......., i got better things to do in life.

It is not the right thing -- from your perspective, because you can't take advantage of it. From the USA point of view multinational executives can potentially create jobs and that's why they must be allowed
You may call it "loophole", based on your understanding of it. However the reality may be different and larger than what you see. So don't axe the branch you are sitting on!

You call the guy with Bsc/bcom and have the 4 programmers reporting to him is the multinational executive. As you might get benefit from it you can call whatever you want.

Born in China, you can't get a Visa, even if you have a job not fillable by an US guy. And same thing if you are spouse, child you need to wait for years.
Can we estimate what kind of relief would be given in these cases?

Openheim: 225K recaptured GC family and Employment. Would provide some relief, not a lot!. As for family, about 50GC would go the husband and wife. it would be a first step.

Lowsy job and recapturing wouldn't help a lot! needs to explore other possibilities...

I don't understand why you are picking up on facts and faults on other post. What mirage is saying is true.I know 3 families stuck up in this GC process...all true cases.

There are some lucky people who have bought old labor substitution ;)who came to US in 2004 and got their GC's cleared and are very :D.

Some really who have come here to study...living in US for past 10 years genuine appliers are really stuck in this. They have all applied their labor and got them cleared only dec 2006.

people who are interested can send those letters if not ignore the thread.

If you are EB2 good for you...Its not that easy to change jobs having families..and when you are satisfied with the employer ,why would they change.

Everyone here want GC to stay in this country. And we all are here to find solutions thru IV - active participation is better.

Pani's letter is not that bad...if you dont like alter what you want to express and send it.People can write what they are facing only.

this is not an argument...just felt bad when you were point blankly picking on them.

    I dont undestand

But one thing I understand there are many , in general like to irritate and hurt other's sentiments and thoughts and pinpoint only faults.

Becoz of this lack of unity only ,most of us face problems.

First of all, I do support issues faced by EB-3 India applicants. However, a letter with many factual errors and words like bonded is not going to help. I am just trying to present my views.

If I were OP, I will at least show my letter for some kind of legal review before sending. After all who would like to make condition bad to worse?

Please refer to post by internet couple of posts back. He has raised many good points.

    Good Luck to everyone!

AabTuAgaGC and hopefullegalimmigrant Could you advise what date USCIS received your application for Advance Parole? Thanks

Guys, I dont see how it matters....every case is treated differently as we all know..so why bother wasting time on such questions... Instead please concentrate on the IV led efforts.. LETTERS CAMPAIGN.....

Please look at the bigger picture, with this being an election year, plus a recession looming large on our heads, we need to get our act together and push for reform.

Preparing for future is one thing but if you think that this is a valuable thread then go with it and enjoy, i just find it disheartening that people are trying to undermine whatever has been achieved by such threads (Like i said, he might be completely right but is there a need to tell it this way) and what are you going to prepare for the future ;) Do you know it ? (If you do, please keep it to yourself and enjoy or cry about it). Right now, i want to be positive and enjoy the fruits of what IV has done to get some relief, why use negative logic to undermine it and that is what i am saying. Leave us alone, who like IV and who want to have a moment's respite. Chill out dude, no offence meant and this my only response, will not reply if you attack me, so cool off.

He is 100% right. Unless USCIS hire people, our EADs and APs will get delayed. People like me have travel plans in Jan. I do not want to go for Visa stamping. I am concerned.

7/06/2007: Temporary Restraining Order of July Visa Bulletin Lawsuit Filed in the U.S. District Court for the Northern District of Illinois as Separate from AILF Class Action

    * On July 6, 2007, the attorneys of Azulay, Horn & Seiden lawfirm filed this lawsuit individually in Illinois.
Ok here I go again in this Chicken and Egg situation......

Now that someone filed a lawsuit to invalidate the July VB, which BTW is still CURRENT.......it could invalidate the CURRENT sttatus....of all Eb categories....precisely what DOS USCIS wants....

    My head is spinning.......Beer anyone?

here is the IRS link which says all non resident aliens will not receive the check, irrespective if they have a SSN or not. Last I knew every H1 is a non-resident alien.

    http://www.irs.gov/newsroom/article/0,,id=179181,00.html

    Snippet from the site:-

Q: I know some people wont get a stimulus payment. How do I know if Im one of them?

A: You wont get a stimulus payment in 2008, if any of the following apply to you:

    *
You dont file a 2007 tax return.
    *
Your net income tax liability is zero and your qualifying income is less than $3,000. To determine your qualifying income, add together your wages, net self-employment income, nontaxable combat pay, Social Security benefits, certain Railroad Retirement benefits and certain veterans payments.
    *
You can be claimed as a dependent on someone elses return. For example, this would include a child or student who can be claimed on a parents return.
    *
You do not have a valid Social Security Number.
    *
    You are a nonresident alien.
    *
You file Form 1040NR or Form 1040NR-EZ, Form 1040PR or Form 1040SS for 2007.

I am not sure if this is possible at all. But just wanted to see.

If my Wife's employer starts GC for her on EB2, can my case be ported / interfile to her's? She is dependent on my GC application.

    Jayant,
But again, the thing to know about this stimulus package/rebate is that this is not FREE money; it is merely an advance on your 2008 tax return. Remember that and think twice before you spend it foolishly. Better still, send it to IV, contribute to an IRA or fund your kid's 529 plan.

    Courtesy by the link:
    http://www.irs.gov/newsroom/article/0,,id=179181,00.html

    ajay:

This was my source where I had read it about a month ago: http://money.cnn.com/2008/02/08/pf/taxes/rebates_what_you_need_to_know/ It was included in the answer for the question "Do I have to pay my rebate back". However, it appears CNN removed it...here's the ruckus about it: http://www.newsbusters.org/blogs/noel-sheppard/2008/02/08/cnn-deletes-line-about-tax-rebates-being-advance

Anyway, thanks for pointing out. I will update my earlier post.

So the correct information seems to be as follows:
Impact on 2008 Tax Returns: The stimulus rebates will be calculated by the IRS using information on the 2007 tax returns. If taxpayers were entitled to a larger rebate based on their 2008 income, those taxpayers will be able to claim a tax credit for the additional amount. Taxpayers won't have to pay back the rebate, however, if using their 2008 income would result in a lower rebate amount.

In any case, whether it is free money or not, the fact remains that some of the best ways to spend it is by sending it to IV, contributing to an IRA or funding your kid's 529 plan.

    Thanks,
    Jayant

I don't agree with your opinion on blocking anyone from interfiling. You have a choice to file in any EB category. Share the reason why you filed EB3 instead of EB1? Grow some balls you efin crybaby!

Somehow i still think PD will be important.People are wondering how they are gonna pull out earlier pd's from the thousands that will pour in.Well, while entering the file into the system, they have to enter all this data right,in order to issue receipts.Surely they have a way of sorting the whole file by PD,becoz they know that after the retrogression,as and when visa numbers become available, they can just haul out the files by PD and see if security checks and fp are done!!In this case RD's are useless, except for EAD's and AP's or maybe to sort out the apps among the current dates itself!!!!If so,they can allot a number and we see the green!!!I'm sure i am missing out some key plot point here...but i wish the processing was as simple as the above!!!

I came here at an old age compared to most of you on this forum. Now I have two kids in college and a third one waiting to enter next year. This is my sixth year here and I have no immediate plan of returning to my home country.
Having a GC will ease the financial burden of seeing my kids through college. Thereafter, we plan on starting a family business that will export technology to my home country (all my sons are studying computer engineering) where opportunities are increasingly available for such ventures.
My wife and I plan to retire and go back home (by which time I hope we would be US citizens). Towards that end we are building our retirement home in Nigeria. As for my sons, I have given up hope that they will ever return to Nigeria to live!
I have two brothers who are already US citizens and have filed for our parents so I don't miss being with my parents as they come and go as they wish.
So to me, the value of the GC will be to eventually get US citizenship, retire and be able to get my social security and medicare and finally go back home with the ability to visit my kids and grand kids in the future.
