My PERM was filed on July 18, 2007. PERM got approved on July 26, 2007.
I-140/I-485 concurrent will be filed in first week of august 2007.
Which fee will be applied in this case ? New August filing fee or same July filing fee?
USCIS FAQ are confusing for this scenerio. I am sure lot of people are in the same boat. Kindly let me know what is the right filing fee for this scenerio.

My case is NSC>>CSC>>NSC and the received date is listed incorrectly on transfer notice....
Receipt Notice from CSC has correct received date of July 31st 2007
but
Transfer Notice from NSC has received date of Oct 12th 2007
Oct 12th seems to be the date when my case was tranferred back to NSC.
I have 3 questions for you...
1) Are other folks also observing this in their case?
2) Will NSC process my case based on Received date from (CSC notice) or their own transfer notice?
3) Whats the process to get received date fixed?

Not surprising, but surprising that Luis would admit it. And if this is the case (and I think it is), then the question is whether we wait until 2011 or later to push again or finally decide it's time to look at other strategies like piecemeal reform (pass DREAM, AgJobs, legal immigration reform now and deal with legalization later) or look at administrative actions like TPS or parole and a moratorium on deportations for people who would otherwise meet the requirements of a proposed legalization program.

I am currently on H1B with a temp status (B1) and in-between jobs. My partner is in the process of becoming a US citizen. He has had his Green Card for years and obtained it through his ex-spouse's job while they were still married. He has been divorced for about a year now and started the citizenship application process a couple of months ago. We are thinking of getting married after he gets his citizenship. My question is: does it matter if we get married before or after he obtains his citizenship? We heard rumors that a previous marriage might be a factor in whether I will be able to obtain a Green Card. Thank you very much in advance for your help!

Every day, a small Texas company compiles the reports and sells them to lobbyists, lawyers and others who pay thousands of dollars for a peek at the reports and what they say about the congressional agenda. And it's all legal.
"How I get them is my trade secret . . . but I get them all," said Walt Seager, who digs up the reports for Gallery Watch, a legislative tracking service.
The Congressional Research Service (CRS) was established in 1914 as Congress's supplier of nonpartisan research and analysis. Its reports are neither classified nor copyrighted, but they've long been the exclusive property of lawmakers, who distribute them as they see fit. Taxpayers supply the agency's $100 million annual budget, inspiring open-government groups and some lawmakers, including Sens. John McCain (R-Ariz.) and Patrick J. Leahy (D-Vt.) to push for public release of CRS reports.
Aftergood and others have fought back by posting every CRS report they can find on their Web sites. But watchdog groups have released only about 10 percent of the total, not enough to reveal the patterns that suggest what Congress might do next.
Subscribers to Gallery Watch pay about $4,000 a year to get all the CRS reports, online and searchable, delivered weekly.
At a recent meeting for potential customers, Riendeau explained that clients scan the reports for intelligence "kind of how the CIA operates," by spotting the political trends suggested by their contents and timing, he said. About a year ago, lawmakers made a flurry of requests for CRS reports related to North Korean counterfeiting of U.S. currency; not until months later, when the Treasury Department cracked down on North Korea, did the issue appear in newspapers.

I have heard in the past from a lawyer that when in H1B status the filing of Green Card must be done and labor certification approved before the 5th anniversary of H1B status. In other words, one cannot start the process for a Green Card in the 6th year of H1B status.
Is this correct? Or is the lawyer being overly cautious?
If such a rule does exist can you please point me to the exact regulation?

Hi,
I am planning to go to India for 3 months. I have EAD and AP, H1B visa stamping valid till 08/30/2010. Now I am on EAD.
From past 3 months, I don’t have project, so I am thinking to go India and come back in the month of Jan 2010 (if US market improves).
My wife is working on EAD and she will be staying in US.
What are the problems I may face at POE, US? (Possible Chicago POE)
Please let me know, what r all docs required and what r all questions will be asked, if I enter on AP or on valid H1B visa stamp.
