I posted this in the Non-immigrant visa section, but I'd also like to get a professional opinion. Sorry for the double post.
I have a rather simple question to ask. I came to the US on a J2 visa with my wife who entered a Ph.D. program. Last year I was accepted into the same program, starting this fall. I didn't change my J2 to J1 because I was waiting for a TAship job offer that would grant me a fee waiver.
Now we're back in the States and there is an on-campus job opportunity that would grant me a fee waiver. I am considering either a) staying on J2 but getting a work permit or b) changing my status to J1.
What I'd like to know is, can I sign a contract with an on-campus employer and start working while my J1 change is being processed? It doesn't really matter much if this means that my paychecks will be delayed; like I said, I would welcome the opportunity to get the fee waiver.

My case was filed on july 2 and got rejected due to incorrect fees. I was told, it was mail room error and was refiled on Sep 12th. I was under the impression that all the rejected cases have receipts numbers and the cases are entered in USCIS database.
I called USCIS and my case information is not in database yet. My attorney told me that they only have a reference number for inquiry(yet to explain why no receipt number instead).
Have you guys seen this happening in other cases?

Hi All,
My wife is on H1 since Oct 2009. No paystubs. Now she want to come back on H4. Her H4 stamping expired. I have my H1 renewed in Oct 2009 and need stamping.
What are the best and low risk options to convert to H4 status. Please advice

Hello,
I have already filed I-751 under removal from country results in extreme hardship,I am going through divorce process,I want to change cateogory in I-751 [marrige entered into good faith but terminated by divorce] ,so please anybody can tell me that when I will get me my divorce decree I have to refile new I-751 for cateogory change into------marriage entered into good faith but terminated by divorce.so plz help me i need to refile or just only amendment letter to uscis.if any body has gone through this process plz help me.

While renewing, on the form, there are 2 questions:
14 Current Immigration Status
15 Manner of Last Entry
(both seem to have the same answer)

My friend and his wife re-entered US on AP a couple of weeks ago....They were paroled into US till Apr 2009. Their APs are valid till Oct 2008. Now his wife needs to go back to her home country immediately for a while (not sure how long due to family emergency).... If she doesn't plan to return before her current AP expires, what are her options to re-enter. My friend is still on H1 status valid till 2010, no H1/H4 visa stamps.....If she intends to stay home longer, can she re-enter US on a H4 visa after getting it stamped...If she plans to return before her current AP expires, say in Sep 2008, is it safe to use AP because she will be out of the country for 5 months if she leaves now and we are not sure if someone can stay out of US for that long and re-enter on AP.....Any suggestions...His PD is April 2004 EB-3 India

My employer is not willing to give the user id and password of the secured sire through which they filed the labor.

Status of PERM can only be checked by your employer (with their user id and password of the secured site). Unfortunately there is no other way to check the status.

I came in on an F1 and got transfered to a H1B without leaving the country.
My H1 was approved for 3 years ie till 2012.
Due to problems at my work place, my H1 got revoked by my employer.
I'm in the medical profession, hence, jobs are few and far between if removed form a training program such as I was in. The next cycle of jobs dont start employment till July 2011.
I am currently within the 180 day limit.
What are my options? My countrys consulate is known to be tight fisted with visas, especially as I have overstayed since I lost my job abruptly.
If my fiance and I do get married, am I eligible for for adjustment of status?
Please help!

Company "A" negotiating with a person who does not have paystubs, as he always been on bench.
during this time Company "B" apply for H-1B Transfer(without paystubs as they plan to submit later in a week or so)
Company "A" did the settlement and issues paystubs etc... but same time they apply cancellation of H1.
My I-94 is valid untill dec-09
Can a transfer be done like this???
Please advise as i am dying day and night.............do not make a fun of it.
Is it possible??

I have attended visa interview at US Consulate in Hyderabad for Blanket L1B.
I have answered everything very clearly and to the point. But, the VO told me that there will be some more information needed and she directed me to another counter.
There a guy gave me a form, I have filled my name, father's name, mother's name, education details, and employment history. Then I was issued a receipt, stating the Administrative Processing will be carried out.
How long will it take for this process?:confused:

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

It is a one way street once that check is cashed. No refunds from USCIS. If the application gets returned from the mailroom for some mistake like missing signature, you will get your check submitted back.
