    Only 95000 GCs? I thought the recap number is somewhere in the 200K range. Or is this family based GC for which 95K will be available?

    Max waiting country Philippines (family based) = 22 years
    if recapture enacted we shortened it for a few months.

    Very good analysis by the guy currently speaking. I love it! basically he is laughing at the 'family values as defended by the USCIS and DOS'. What a poor job they are doing!

    I just did the math.

    I am sure most of you have assets worth of at least $150,000. So if 300,000 are stuck in the backlog. This would mean if these guys leave this country, then that would be $45 trillion loss for USA.

    Guys is there a way to get some media publicity of the possible loss of $45 trillion for USA due to US Immigration mess??

    This is becoming like a person who buys lottery regularly. Then every time before the results are going to come out, starts dreaming and then gets disappointed as his number is not drawn.

    I am not entirely sure about the 1% number. I feel it may be somewhat higher than that.
    If indeed the ratio is 1%, then things are very dire, since with the economy as it is, we probably will not see any expansion in EB immigration in the near term.
    Additionally the L1-EB1 route as multinational manager is very much alive and well, and is arguably the preferred and probably only viable route for any Indian prospectively attempting to immigrate to the USA. The numbers of such applicants might be larger than we know. If anyone has any data on that and specifically about the change in those numbers ever since retrogression hit, please post it.
    In all honesty, I know the guys applying anew need a little hope and encouragement, but with perhaps 300K people and rising ahead of you in the EB India queue and slim to none chance of EB expansion in the near term, what are the odds of getting through that line in the next decade?

    It is not the right thing -- from your perspective, because you can't take advantage of it. From the USA point of view multinational executives can potentially create jobs and that's why they must be allowed
    You may call it "loophole", based on your understanding of it. However the reality may be different and larger than what you see. So don't axe the branch you are sitting on!

    My friend, "USA point of view is multinational executives can potentially create jobs", but the reality is the other way round. They are here to to make the transition happen from Onshore to Offshore. I have complete knowledge on how this EB1 thing works , as I was one of them once upon a time before taking up my current job.

    And to make things more clear, I didn't quit the job just because I wasn't getting a chance to file in EB1, its because you are expected to work 24/7, Yes I mean 24/7 having to take calls midnight, logging and working from home in odd hours, any day time with offshore, onshore, clients and paid like 65k. Life sucked and I couldn't take it any more and had to leave..

    Given the current market conditions,I dont think there will be a lot of new EB1,EB-2 ROW filings.Given that EB1 and EB2 ROW are current,there will be considerable overflow to EB2 I and C.The chances are very good that EB2 I and C will move faster than it moved late last year and early this year.April 2009 quarter opens new Visa Numbers too,If EB2 ROW and EB1 are slowed because of economy then certainly there should be some additional visa numbers available for EB2 I and C.At this stage it depends on PERM EB2 ROW data.

    Yes story is thesame. The US is unfair to high skilled immigrants. I lived in the US for 8 years. School, worked, volunteered, purchased a home, etc. When the down turn came, I was left high and dry. No unemployment benefits with all the taxes and social security that I have paid. To make matters worse, I was required to depart the same day. I had properties... been living here for 8 years!!

    Even though I made this choice, it does not make it humane to have such a system. You ask, what does the US really gain by making people go through the stress, anxiety, sleepless nights? Nothing.

    I am sorry for posting in here, but I was wondering if someone actually went in person to the Houston Consulate to get their passport renewed. Also, do we need to have any reason to attend in person at the Consulate such as emergency, etc.

    I am from India and my passport is expiring on Aug 17. I read before in the forum that it is better to go in person to renew the passport. Any experiences please let me know.

    If you are around houston, it would be better to go in person. I think they accept the applications only until noon. They would tell u a Pickup date or u have an option to get it mailed. The passport is ready for pickup in 10 working days or so.

    I have filed I-129 and I-539 at VSC (RD 7/16/07) and also concurrently file I-140 + 485 at NSC on 7/2/07 (No Checks cashed yet). My H1 and spouse's H4 expires on 9/30/07. And so does our DL.

    I called the PA DoT and they said that they need the following documentation for the DL renewal:

    H1B & H4 Visa
    Passport
    I-94
    Visa
    Proof of employment (For H1 only)
    2 Proofs of residency (For H1 only)
    Rejection letter from SS Office (for H4 only)

    They will not accept a Receipt Notice. They also said that if the Visa wasn’t valid for more than a year, they will not renew DL. I don’t know if they will accept a Visa stamp on the passport or approval of I-129 & I-539 will suffice.

    From your experience, at this time, if we apply for PP, will they process my spouse's application along with mine, so both approvals come around the same time? Please advise.

    As per the latest update provided by the DOL to the AILA, of the 363,000 backlog cases pending 108,000 have been completed; 50,000 Certifications have been issued and 255,000 cases remain pending. The DOL further advises that they are on track to issue 45 day letters on all remaining cases by end of June 2006.

    My PD is Sept 2003 and I haven't yet got my 45 - day letter. :(

    What are the chances for the PD moving to Mid 2007 by end of 2010 ? :(

    are you referring to EB2-India? Without any legislative or administrative changes the chances of reaching 2007 next year are pretty much zero IMO.

    If I were to play the prediction game, based on the stats that USCIS released and their own statements in this months VB, this is what I would guess [Q1 meaning Jan-Feb-March: calendar quarter, not USCIS quarter which runs from Sept]:

    - Q1 2010 : EB2-I reaches Feb and or early March

    >> Reasoning: its already at Jan-end and there are tons of cases in March. because PERM was about to start from April 2005, lots and lots of companies pushed and filed for labor in March. So Jan will be crossed and most likely Feb also. But March is a big hump to cross.

    - Q2 2010 : EB2-I goes "unavailable". Probably in May, or in June

    >> EB2-India should exhaust its annual quota for the quarter well within the cases from Jan/Feb/early-March. So now the VB would go unavailable.

    - Q3 2010 : EB2-I goes to April/May/June-2005 in July, then Dec 2005 by Sept VB.

    >> the big spillover of visa starts. Note that spillover has not yet happened. THere is speculation at this point, but traditionally whenever there is spillover (look at last 3 years VB) India and China have the same PD because thats how the visas can spill over equally to both of them. The state dept's own prediction is dates will reach December and thats likely. Note that in their prediction (in the VB) dates for India and China are identical as is expected when spillover takes place. This is the time when the big bump of cases at March should get levelled out.

    - Q4 2010 : EB2-I goes to Oct 2005

    >> 6 months past PERM the number of filings had picked up again, so based on the EB-I pending cases stats come October 2010 the date should roll back to October 2005. Spillover wont be in effect and India will be back to its annual 7% limit.

    - Q1 2011 : EB2-I goes to Dec 2005

    >> dates will creep along slowly/

    - Q2 2011 : Dec-2005 or 'U'.

    >> same story: India quickly exhausts its annual quota, and must now wait for spillover.

    - Q3 2011 : EB2-I goes to March/June 2006

    >> spillover happens, but unlike earlier there are lots and lots of cases from 2005-end to first half of 2006. So even with spillover the dates are unlikely to go past June 2006.
